Abstract：The location of NIMBY facilities inevitably has a negative impact on the vital interests of the surrounding residents，and the imbalance of interests forms the "trolley problem" in the "NIMBY era".The negative externalities of NIMBY facilities and the unpredictability of expected losses have caused public panic， the public may resort to extreme violent means to resist，resulting in conflicts. In order to efectively resolve theinter-subject interest conflicts arising in the location of NIMBY facilities，it is necessry to analyze the elements specifically and clarify the payment functions of the government，enterprises and the public in the conflict game. In terms of the realization of the public's environmental discourse power， the improvement of the accountability system，the improvement of the law enforcement process，and the construction of the multi-subject participation mechanism，effective legal paths to solve the dilemma of NIMBYconflict should be explored，the quality of the rule of law in the location of NIMBY facilities should be investigated，and a social governance pattern of co-construction，co-governance and sharing in the new era should be created.
